Sexual Harassment: Are You Exposed To It?

Sexual pestering is a type of sex exploitation that violates state and federal laws. In the workplace this situation can have two forms: quid pro quo and hostile job environment harassment. The quid pro quo occurs when a person above another at work desires sexual favors for some job profit like a promotion, or threatens with a job loss and even termination if the worker does not concede to the sexual advances.

Intimidating or hostile environment includes grave and persistent sexual job environments, involving nasty physical touching, offensive language, pornographic displays, sexual attitude in the job place and other strange behaviors by the supervisors or co-workers. This situation normally affects a big group of employees. Still workers who are not targeted for sexual touching or advances may declare hostile environment claims based on their individual power to labor in an environment that, as a whole, is vulgar to them and others. The abuser may be the boss of the victim, a manager of other department, a partner and even a customer. For the harasser, the victim does not have to be necessarily a person of the opposite sex.

If you are or have been a victim of sexual harassment especially in a job where there are more sufferers and/or witnesses and your claims have failed, you can have an example or practice hostile job environment claim. Normally, people think that just women suffer from this situation, but it is a myth. Today, more and more men are also suffering from this problem. Sometimes victims do not do anything to stop this because they do not want to loose their job or sometimes because it is embarrassing especially for men. If you consider that you are being a victim of sexual harassment, contact your attorney and ask him/her about the opportunities you have to make a legal claim against the harasser or even against the company; but do it now!
